Employment-Based Second Preference Immigrant Visas (EB-2)

This visa category includes two different classifications for permanent residence.

First, it includes foreign workers who hold an advanced degree (master’s degree or above) and are being sponsored by an employer to fill a position that requires at least a master’s degree. An alternative to the master’s degree requirement is a bachelor’s degree and at least five years of progressive post-baccalaureate experience.

Second, this category includes foreign nationals of exceptional ability in sciences, arts or business whose expertise is significantly above that ordinarily encountered and whose presence will substantially benefit the United States.

PERM labor certification is required for this immigrant visa category, unless the worker will serve the national interest. A “National Interest Waiver” will waive the labor certification requirement if it can be established that the foreign national’s work has substantial merit and is of national importance, the foreign national has the qualifications and proven ability to do the work, and it would benefit the United States to waive the job offer and labor certification.
